Data Protection & Privacy Notice

Privacy Notice

Elekevu is an independent operations practice based in Nairobi, Kenya. This notice explains how personal information submitted through this website is handled under the Kenya Data Protection Act, 2019.

1. Our Core Privacy Position

Elekevu does not use advertising trackers, third-party marketing beacons, cross-site identity graphs, or ad-retargeting cookies. We do not sell, rent, or trade your inquiry information under any circumstances.

2. Information We Collect

We only collect information that you voluntarily submit through our Fit Check form:

  • Contact details: Your name, business name, and email address (plus optional phone number).
  • Operational inquiry: Your description of the recurring process problem your business experiences.
  • Attribution (optional): How you heard about Elekevu.

Data Minimization Note: Please do not include confidential customer records, employee identity numbers, bank details, or sensitive personal data in this initial inquiry.

3. Purpose and Legal Basis

We process your inquiry solely under our legitimate interest in reviewing the operational problem you describe, determining whether there is a bounded intervention worth pursuing, and replying to you with an honest routing decision.

4. Infrastructure & Processors

To provide this website and receive inquiries securely, we rely on two technical service providers acting as processors:

  • Vercel Inc.: Application hosting and serverless infrastructure, including privacy-conscious aggregate analytics and performance measurement.
  • Resend Inc.: Transactional email infrastructure used solely to dispatch your inquiry message securely to our inbox.

Inquiries are transmitted over encrypted TLS connections. We do not maintain a permanent shadow CRM database on this website.

5. Data Retention

If a Fit Check inquiry does not proceed into an active consulting engagement, we routinely delete the inquiry from our email inbox after 90 days. Active client engagements are governed by formal confidentiality agreements and engagement contracts.

6. Your Rights

Under Sections 26–40 of the Kenya Data Protection Act, 2019, you have the right to be informed about how your data is used, request access to your submitted data, request correction of inaccurate data, or request deletion of your inquiry details.

To exercise any of these rights, contact Alan Kivuti directly at elekevuconsulting@gmail.com.
